Software Compatibility Notes

PRESTASHOP THEMES COMPATIBILITY

This software is compatible with the default PrestaShop theme that comes with the PrestaShop installation. The 3rd party or customized themes may require manual integration.

MOBILE VERSION

This software is not compatible with the mobile version of the PrestaShop solution.

Software License Agreement

PLEASE READ THE TERMS AND CONDITIONS OF THIS LICENSE AGREEMENT CAREFULLY BEFORE COMPLETING THE INSTALLATION PROCESS AND USING THE SOFTWARE.

This software license agreement (SLA) is a legal agreement between you (either an individual or, if purchased or otherwise acquired by or for an entity, an entity) – the “Licensee” and PS&More, its suppliers and partners (the “Licensor”). The “SOFTWARE” means the PS&More software product and any corresponding documentation, associated media, printed materials, and online or electronic documentation, and all updates or upgrades of the above that are provided to you. By installing, copying, or otherwise using the SOFTWARE, you agree to be bound by the terms of this SLA.

This SLA is the entire and exclusive agreement between Licensor and Licensee regarding this SOFTWARE. This SLA replaces and supersedes all prior negotiations, dealings, and agreements between Licensor and Licensee regarding this SOFTWARE.

This License Agreement is valid without Licensor's signature. It becomes effective upon the earlier of Licensee's signature or Licensee's use of the Software.

1. GRANT OF LICENSE
a) Under this SLA the Licensor grants to the Licensee a non-exclusive and non-transferable license (the "License") to use the SOFTWARE. This Agreement constitutes a license for use only and is not in any way a modification or a transfer of ownership rights to the SOFTWARE.
b) Under this SLA the SOFTWARE is licensed and not sold.
c) The Licensee may install and use the SOFTWARE only on one production website. It may be installed and used on additional test servers. A license for the SOFTWARE may not be shared, installed or used concurrently on different websites. You are not permitted to make or distribute copies of the SOFTWARE, or electronically transfer the SOFTWARE from one computer to another or over a network without first purchasing the appropriate additional licenses. You are only allowed to make copies of the SOFTWARE as may be necessary for backup and archival purposes.
d) This license does not grant any reseller privileges. You may not sell, rent, lease, or sub-license the SOFTWARE.

2. COPYRIGHT
All title, including but not limited to copyrights, in and to the SOFTWARE and any copies thereof are owned by the Licensor. All title and intellectual property rights in and to the content which may be accessed through use of the SOFTWARE is the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties. This SLA grants you no rights to use such content. All rights not expressly granted are reserved by the Licensor.
You must not remove or alter any copyright notices on any and all copies of the SOFTWARE.

3. NO WARRANTIES
The Licensor expressly disclaims any warranty for the SOFTWARE. The SOFTWARE is provided "as is", without a warranty of any kind, either oral or written, express or implied, including, but not limited to, the implied warranties or conditions of merchantability or fitness for a particular purpose, or the warranty of non-infringement. In no event shall the authors or copyright holders be liable for any claim, damages or other liability, whether in an action of contract, tort or otherwise, arising from, out of or in connection with the SOFTWARE or the use or other dealings in the SOFTWARE. The Licensor further expressly disclaims any warranty or representation to Authorized Users or to any third party.

4. LIMITATION OF LIABILITY
In no event shall the Licensor be liable for any damages (including, without limitation, lost profits, business interruption, or lost information) rising out of 'Authorized Users' use of or inability to use the SOFTWARE, even if the Licensor has been advised of the possibility of such damages. In no event will the Licensor be liable for loss of data or for indirect, special, incidental, consequential (including lost profit), or other damages based in contract, tort or otherwise. The Licensor shall have no liability with respect to the content of the SOFTWARE or any part thereof, including but not limited to errors or omissions contained therein, libel, infringements of rights of publicity, privacy, trademark rights, business interruption, personal injury, loss of privacy, moral rights or the disclosure of confidential information.

5. TERMINATION
Without prejudice to any other rights, Licensor may terminate this SLA if Licensee fail to comply with the terms and conditions of this SLA. In such event, Licensee must destroy all copies of the Software in his possession.

6. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS
Licensee agrees to defend and indemnify Licensor and hold Licensor harmless from all claims, losses, damages, complaints, or expenses connected with or resulting from Licensee's business operations.
Licensee only benefits from a license of use of the Software downloaded, which is non-exclusive, personal, globally, and for the entire duration of the copyright. This license is valid for only one Store. Each additional Store requires a separate license. The SLA does not allow for any transfer of ownership in favor of the other party.

7. REFUND
The SOFTWARE is a downloadable product. Once Licensee downloaded or used the SOFTWARE, it is not eligible for refund.

8. SUPPORT SERVICES
a) The Licensor provides you with support services related to the SOFTWARE ("Support Services"). Any supplemental software code provided to you as part of the Support Services shall be considered part of the SOFTWARE and subject to the terms and conditions of this SLA.
b) The Licensor provides 90 days free technical support with the unmodified Software that is purchased from our site. This support does not include installation or customization of the SOFTWARE. After 90 days, if you still face any issue, the Licensor will try to sort it out. Depending on the complexity, a small fee can be asked from you. This should be discussed personally with each customer.
c) If the Software that is related to the same version of PrestaShop have been enhanced since the day you purchased, you'll be eligible for at least 2 times of free update within 1 (one) year from the date of purchase, as long as the prices for the Software stay the same. If the prices for the Software that is related to the same version of PrestaShop have been changed, you will need to pay for the difference. After 1 (one) year from the date of purchase, you will need to pay a small amount of update fee plus the price difference if you choose to update.
d) PrestaShop software versions (both major and minor), officially released by PrestaShop and available for download from the official PrestaShop site, are considered to be different versions in the context of this SLA.
e) If the Software has a new version related to the new version of PrestaShop (either major or minor), you should check our online store and/or contact our customer service for available options.
